1. ABOUT US
1.1. The website www.minegen.dk is owned and operated by Min Egen ApS (“MinEgen” or “Us”).

2. OUR TERMS AND CONDITIONS
2.1. Our terms and conditions (“Terms and Conditions”) apply to our delivery of our goods to you when you order/purchase an item on our website.
2.2. We encourage you to read our Terms and Conditions carefully before ordering an item from Us.
2.3. We may change and update the Terms and Conditions from time to time with effect for your future purchases on our website. Therefore, you will be asked to accept our Terms and Conditions each time you shop with us.
2.4. If you do not accept our Terms and Conditions, you cannot order goods on our website.
2.5. An updated version of the Terms and Conditions is always available on our website.


3. PRICES AND PAYMENT
3.1. All prices are stated in Danish kroner (DKK) or US Dollars ($) including 25% VAT and other taxes/duties.
3.2. The total price you have to pay for your item(s), including any shipping and fees/charges for credit card payments, will be calculated before you complete your order.
3.3. Your delivery costs will vary depending on the delivery option selected/offered for delivery of the item in question. You will be informed of the delivery costs before you complete your order.
3.4. Payment for your item(s) is made when you complete your order. If we need to ship the item to you, we will not deduct the money until we ship the item from our warehouse.
3.5. When you pay for an item directly with an international payment card, the amount will be reserved on your card immediately. The amount will only be debited from your card when the item is shipped. The reservation will then automatically expire. If you have any questions about the reservation, its duration, or other related matters, please contact your card issuer, who will be able to assist you. We also refer you to your agreement with your card issuer regarding the use of your payment card.
4. PAYMENT METHODS
4.1. You can pay with Visa, Mastercard, ApplePay, and certain other payment cards.
4.2. You can also pay with our gift cards. However, you can only use one gift card per order.
5. ORDERING GOODS ON OUR WEBSITE
5.1. General
5.1.1. You must be at least 18 years old and have a valid credit card that we accept as a means of payment in order to order our goods on our website. If you are under 18 years of age, you must have a legal basis for trading with us.
5.1.2. Our webshop at www.minegen.dk is open 24 hours a day, but it may be closed for maintenance. We will, of course, try (as far as possible) to maintain our webshop at night.
5.1.3. If you place an order on a weekend or public holiday, your order will not be processed until the next business day.
5.1.4. We will only accept your order if your payment details are correct and if we have no reason to believe that the order will be used for illegal activities or that you do not meet the requirements in our Terms and Conditions.
5.2. When are you bound by your order?
5.2.1. Before completing your purchase, you have the opportunity to customize your order and your information.
5.2.2. Once you have completed your purchase, you are bound by your order and will receive an order confirmation from us by email.
5.2.3. If you make a mistake in your order, please contact our customer service team, who will be happy to help you. If you have changed your mind about your order, you have a 14-day right of withdrawal for standard goods – however, this does not apply to custom-made goods (read more about your right of withdrawal in the section “Right of withdrawal” below).
5.3. When are we bound by your order?
5.3.1. We are only bound by your order once we have sent you an order confirmation. Until then, we reserve the right to reject your order in the event of printing errors, technical problems, delivery failures, and similar circumstances.
6. DELIVERY
6.1. Your order will be delivered to the delivery address you selected when placing your order.
6.2. We strive to deliver your order as quickly as possible. The expected delivery time is stated under each product.
6.3. If we do not have all the items you have ordered in stock, we may send you the items we have in stock first. When we receive the items you are missing, we will send them to you subsequently. You may therefore find that we send your order in several batches.
7. RIGHT OF WITHDRAWAL
7.1. General
7.1.1. If you are a consumer, you may withdraw from the purchase of your item within 14 days without giving any reason.
7.1.2. The cancellation period expires 14 days from the day on which you or someone receiving the item on your behalf (not the delivery driver) takes physical possession of the item.
7.1.3. If you have ordered several of our goods in the same order, but we have not been able to deliver your goods to you at the same time (in the same order), the withdrawal period for the goods expires 14 days after the day on which you receive the last item (in physical possession). In cases where more than one item has been ordered in the same order, but the items are delivered individually, the cancellation period expires 14 days after the day on which you or a third party designated by you (not the carrier) takes physical possession of the last item.
7.1.4. If you have ordered an item that consists of several batches or parts, the cancellation period expires 14 days after the day you receive the last batch or part of the item (in physical possession).
7.1.4.1. If you wish to exercise your right of withdrawal, you must notify Us that you wish to exercise your right of withdrawal in an unequivocal statement (in a clear and unambiguous manner) – e.g. by email or letter. You may also choose to use our standard withdrawal form.
7.1.4.2. You have complied with the withdrawal period if you send Us the notification that you wish to exercise your right of withdrawal before the withdrawal period expires.
7.2. What happens when you exercise your right of withdrawal?
7.2.1. If you have exercised your right of withdrawal, we will refund your payment, including any delivery costs, without undue delay and no later than 14 days from the date on which we received your notification of your exercise of your right of withdrawal.
7.2.2. However, if you have chosen a delivery method other than our standard delivery, we will only refund the part of the delivery costs that corresponds to our standard delivery.
7.2.3. We will refund your payment using the same means of payment that you used for your purchase, unless you have expressly agreed to a different form of refund (e.g., a credit note).
7.2.4. You will not be charged any fees in connection with the refund.
7.2.5. You must return the item to us without undue delay and no later than 14 days from the date on which you notified us that you wish to exercise your right of withdrawal. You have complied with the withdrawal period if you return the item before the expiry of the 14 days.
7.2.6. You must pay your own expenses in connection with returning the item (including shipping).
7.2.7. We may withhold your refund until we have received the item or you have provided documentation of your return of the item, whichever is earlier.

7.3. Custom-made goods – the right of withdrawal does not apply
7.3.1. The right of withdrawal does not apply to goods that are custom-made or have been given a distinct personal touch (e.g. goods with personally selected embroidery or embroidered names and the like).
8. DEFECTIVE AND INCORRECT ITEMS
8.1. If your item is defective or if we have delivered the wrong item to you, please contact our customer service as soon as possible. You can find our contact details at the bottom of our Terms and Conditions or in your order confirmation.
8.2. If your item is defective or if you have received the wrong item, you have the option to choose between:
a) returning the item and getting your money back,
b) returning the item and getting a new, equivalent item (replacement delivery)
c) keeping the item and receiving a proportionate discount
d) keeping the item and having the defect remedied
8.3. In order for our customer service to help you if you have received a defective or incorrect item, you must provide your order number, item number, and a detailed description of what is wrong with the item.
8.4. If you have received a defective or incorrect item that you need to return, we will cover the cost of returning the item to us.
8.5. If your item is defective, the rules on defects in the Sale of Goods Act apply.
9. RETURNS
9.1. If you need to return an item to us (e.g., if you have changed your mind about your purchase or your item is defective), you must return the item to the following address:

9.2. When returning an item, all parts of the item must be returned to us.
9.3. When you return an item to us, you are responsible for ensuring that the item is packaged securely. You bear the risk for the item until we have received the item in return (physical possession). We therefore recommend that you keep your receipt for shipping the item.
9.4. You are responsible for any deterioration in the value of the item resulting from handling other than what is necessary to determine the nature, characteristics, and functioning of the item.
9.5. If the value of the item has been reduced, we will deduct the reduction in value from the purchase price you paid for the item before refunding the purchase price to you.
9.5.1. Complaints
9.5.1.1. Complaints about defects in your goods must be made directly to Us within a reasonable time after you have discovered the defect.
9.5.1.2. There is a complaint period of 2 years, and as a consumer, you must therefore complain within 2 years of delivery of the goods. If the complaint period is not observed, your right to claim for defects will lapse, unless we have undertaken to guarantee the item for a longer period.

10. FORCE MAJEURE
10.1. We are not liable to you if, after you place your order, circumstances arise that prevent or delay our fulfillment of your order. Such circumstances include external circumstances that humans cannot avert, war, mobilization, breakdown of telecommunications/customer infrastructure, external security incidents (e.g., hacker attacks, computer virus attacks, or destructive behavior by a third party), natural disasters and natural conditions that make it impossible to fulfill your order/purchase, strikes, lockouts, fires, blockades, vandalism, orders from public authorities and/or rights holders, outbreaks of epidemics or pandemics, global health emergencies, and other circumstances beyond our direct control.
11. PERSONAL DATA
11.1. We treat your personal data confidentially. We have drawn up a privacy policy that explains how we process the personal data you provide to us in connection with your purchase and when using our website. You can find our privacy policy here.
12. OTHER
12.1. Updating our website
12.1.1. We do our best to update the website and ensure that prices, offers, descriptions, and other information about the products are correct. However, spelling mistakes, errors in prices, offers, descriptions, and other information about the products may occur, and sometimes we discover that the price of a product has been stated incorrectly.
13. TRANSFER
13.1. We may choose to transfer our agreement with you in whole or in part to (a) one of our affiliated companies or (b) to a third party as part of a divestiture of one or more of its companies, business units, etc.
14. COMPLAINTS
14.1. If there is a problem with your item, or if your item is defective, you must first contact our customer service department.
14.2. If you are dissatisfied with our handling of your problem with an item, you can submit a complaint to the Center for Complaint Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Center for Complaint Resolution via the Complaint Portal. If you want to submit a complaint to the Center for Complaint Resolution, you must first send your complaint to us. It may be a good idea to send a written complaint to us so that you can document that you have complained if the Center for Complaint Resolution requests documentation. To file a complaint, the item or service you wish to complain about must have cost at least DKK 1,110 and no more than DKK 100,000. For complaints about clothing and shoes, the price must be at least DKK 720. The amount limits are subject to change. You must pay a fee to the Complaints Portal to have your complaint processed.
14.3. You can also use the European Commission’s online complaint portal to submit a complaint. This is particularly relevant if you are a consumer residing in another EU country. You can submit your complaint on the European Commission’s online complaint portal. When submitting a complaint, you must provide our email address: tine@minegen.dk.
15. LAW AND JURISDICTION
15.1. Any order/purchase you make with Us is governed by and shall be interpreted in accordance with Danish law, except for (a) rules that lead to the application of legislation other than Danish law, and (b) the United Nations Convention on Contracts for the International Sale of Goods (CISG).
15.2. Any dispute or claim arising out of or in connection with your order/purchase shall be settled by a competent court at the place of jurisdiction of Min Egen ApS.
